Terms and Conditions
Welcome to Pascale Kirk Photography. These Terms and Conditions outline the rights and responsibilities for all transactions, services, and interactions with Pascale Kirk Photography. By engaging with our services or purchasing our products, you agree to the following terms:
1. General
1.1. These terms apply to all purchases of prints, books, digital photographs, and photography services, including commissions.

1.2. Pascale Kirk Photography reserves the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.
2. Payments
2.1. Prints, Books, and Digital Photographs: Full payment is required at the time of purchase. Orders will not be processed until payment is received in full.

2.2. Commissions:

• A 50% deposit is required before the commencement of any commissioned work.

• The remaining 50% must be paid in full upon project completion but before the delivery of final deliverables.

• Commissions will not proceed without the initial deposit, and final deliverables will not be released until the balance is settled.
   

3. Refunds and Cancellations
3.1. Due to the nature of custom and digital work, refunds are not available once payment is made.

3.2. For commissioned projects, cancellations made after work has commenced will result in the forfeiture of the 50% deposit.

4. Ownership and Copyright
4.1. All photographs, prints, and digital assets remain the intellectual property of Pascale Kirk Photography unless otherwise agreed upon in writing.

4.2. Purchased prints and digital images are for personal use only and may not be reproduced, copied, or distributed for commercial purposes without prior written consent.

5. Delivery
5.1. Delivery timelines for prints, books, and digital files will be communicated at the time of purchase or commission.

5.2. Pascale Kirk Photography is not responsible for delays caused by shipping providers or unforeseen circumstances beyond our control.

6. Liability
6.1. Pascale Kirk Photography is not liable for any loss, damage, or delay in delivering products or services caused by factors outside our reasonable control.

6.2. Any concerns regarding delivered products must be raised within 7 days of receipt.
